You have been in Spain for years, your residence is in order and you finally meet the period to apply for nationality. But right now you are out of work, or self-employed without payslips, and someone tells you that without a contract they will not grant it. Is that true?

No. Since the 2015 reform, an employment contract, a Social Security work history or payslips are not a requirement to apply for Spanish nationality by residence. What is assessed is something else.

Example

Andrea, from Peru, reached two years of legal residence just as her contract ended and she started looking for work. She applied anyway, with her residence card, criminal record certificates and birth certificate. As a national of an Ibero-American country, she only had to pass the CCSE. Her employment situation was not part of the requirements.

When It Is Worth Providing Employment Documents

Although not mandatory, they can strengthen your file when there are doubts: long absences from Spain, frequent changes of address or a history that is hard to follow. In those cases, proving your ties with well-chosen evidence makes the difference.

Mistakes That Delay Nationality

  • Waiting until you have a contract to apply, losing months for no reason.
  • Applying without having passed the DELE A2 or CCSE.
  • Criminal record certificates that are expired or not apostilled.
  • Not checking whether there were interruptions in your legal residence.

Once filed, the Ministry has one year to decide, and if nationality is granted you have 180 days to take the oath.
