The Democratic Memory Law (Ley de Memoria Democrática, LMD) opened a three-year window for descendants of Spaniards to become Spanish by origin. That window closed on 22 October 2025. This 2026 guide explains what the law offered, what is happening with files still pending at consulates, and which routes to Spanish nationality remain open if you missed it.

1) Where Things Stand in 2026
Law 20/2022 of 19 October on Democratic Memory entered into force on 21 October 2022. Its Additional Provision 8 (Disposición adicional octava) allowed certain descendants of Spaniards to opt for Spanish nationality of origin within two years. In July 2024 the Council of Ministers extended that period by one more year. The window closed on 22 October 2025, and Spanish consulates stopped accepting new appointment requests from 23 October 2025.
2) What the Law Offered
Additional Provision 8 created an option to acquire Spanish nationality of origin, with no residence in Spain required, for three main groups:
Descendants of exiles
People born outside Spain whose father or mother, grandfather or grandmother, was originally Spanish and lost or renounced Spanish nationality as a result of exile for political, ideological or belief reasons, or because of sexual orientation or identity. The implementing instruction of the Directorate General for Legal Certainty and Public Faith (Dirección General de Seguridad Jurídica y Fe Pública, DGSJFP) of 25 October 2022 eased proof of exile in many cases.
Children of Spanish women
People born abroad to Spanish women who lost their nationality by marrying a foreigner before the 1978 Constitution came into force.
Adult children of new Spaniards
Adult sons and daughters of Spaniards whose nationality of origin was recognised under the Democratic Memory Law or under the earlier Historical Memory Law (Law 52/2007). This is the route that allowed some great-grandchildren to benefit indirectly, once their parent became Spanish.
How it worked
A declaration of option filed at the Spanish consulate of your place of residence (or a Civil Registry in Spain), with documents proving the family link and the situation of the Spanish ancestor. No language exam and no residence in Spain were required.
Our guide on what great-grandchildren can still do in 2026 explains the indirect route through a parent in more detail.

4) If You Applied in Time: What Happens to Pending Files
Closing the window did not cancel the applications already made. Consulates are still working through a very large backlog, and several have published how they are handling the final phase.
- Appointment requested before the deadline: consulates such as Havana and Panama announced that applicants who requested an appointment by 22 October 2025 (until 23:59 local time) receive credentials to choose a date and time to file their documents. Keep the proof that your request was made in time: it must be included with your original documents.
- Same consulate: the application must be processed at the consular office where the appointment was obtained. Missing an assigned appointment can mean you are not given a new one, so attend on the date set.
- Requests for documents: if the consulate asks for missing or additional documents, answer within the deadline stated in the request. Some consulates warned that incomplete files not corrected in time are refused.
- Processing: delays are long. In June 2026, for example, the Consulate General in Buenos Aires reported that it was still working on files from September 2023.
- Approval and registration: once approved, your birth is registered in the Spanish Civil Registry (through the consular registry). Only then can you apply for a Spanish passport and, in Spain, a DNI (Spanish national identity document).
Why LMD Files Get Refused
- False or altered documents: consulates treat them as grounds for automatic refusal with no chance to correct.
- No proof that the appointment or application was made before 22 October 2025.
- Gaps in the chain of birth and marriage certificates linking you to the Spanish ancestor.
- No evidence that the ancestor was Spanish by origin, or of the loss of nationality or exile where it was required.
- Ignoring a request for documents or answering after the deadline.
- Name and date inconsistencies between records from different countries, left unexplained.
5) Delays and Refusals: What You Can Do
A Democratic Memory option is a Civil Registry procedure, not an immigration or residence procedure. That matters for appeals:
LMD option (Civil Registry)
Who decidesThe consular Civil Registry (or Civil Registry in Spain)
First challengeAppeal to the DGSJFP, within the deadline stated in the decision
CourtCivil courts, after the DGSJFP route
Against delaysWritten requests to speed up, complaints, Ombudsman (Defensor del Pueblo)
Nationality by residence
Who decidesMinistry of Justice
First challengeOptional appeal for reconsideration within one month
CourtContentious-administrative appeal before the National High Court (Audiencia Nacional)
Against delaysSilence after one year counts as refusal and can be taken to court
If your LMD file has been refused, read the decision carefully: it must state which body you can appeal to and the deadline. Do not miss it. If your file is simply stuck, a well-documented written request to the consulate and, if needed, a complaint can help. Our guide on how to file a complaint against a Spanish consulate explains the channels. Court appeals for residence files follow a different route, described in our guide to the court appeal for Spanish nationality.
6) Evidence Problems
Most difficult LMD files are evidence problems: old records, lost archives, different spellings and countries that changed borders or registry systems. Typical evidence:
The Spanish ancestor
Spanish literal birth certificateParish baptism record if the civil one is missingProof of Spanish nationality at the relevant time
The family link
Birth certificates for each generationMarriage certificatesApostille or legalisation and sworn translations
The specific situation
Exile or emigration records where requiredMother’s marriage to a foreigner before 1978Parent’s registration as Spanish (adult children route)
When a record is missing, alternative evidence such as parish archives, immigration and port records, consular registrations or historical archives may help. Our dedicated guide covers evidence problems in Democratic Memory Law files.
7) Missed the Deadline? Routes That Are Still Open
The end of the LMD window does not close every door. The Civil Code still offers routes for many descendants of Spaniards:
Which situation fits you?
Your father or mother was originally Spanish and was born in Spain, or you are under the parental authority of a SpaniardNationality by option →
Your father, mother, grandfather or grandmother was originally Spanish, and you can move to SpainResidence of just 1 year →
You are a national of an Ibero-American country, Andorra, the Philippines, Equatorial Guinea or PortugalResidence of 2 years →
You may already be Spanish by origin through a parent who was Spanish when you were bornNationality by origin →
You have been treated as Spanish in good faith for yearsPossession of status →
Option (Civil Code, art. 20)
WhoChildren of a parent originally Spanish and born in Spain; people who are or were under a Spaniard’s parental authority
Residence in SpainNot required
DeadlineNo deadline for children of a parent originally Spanish and born in Spain; age limits for the parental authority route
Residence, 1 year (art. 22.2.f)
WhoPeople born abroad with a father, mother, grandfather or grandmother originally Spanish
Residence in Spain1 year of legal, continuous residence
DeadlineNone: it is a permanent route
Residence, 2 years (art. 22.1)
WhoNationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal, and people of Sephardic origin
Residence in Spain2 years of legal, continuous residence
DeadlineNone: it is a permanent route
For the residence routes you first need a residence permit in Spain. Many descendants come with a Non-Lucrative Visa, a Digital Nomad Visa or as a family member, then apply for nationality after one or two years. Our guide to Spanish nationality by residence explains the requirements, and our nationality by residence service handles the application.
8) Real-Life Examples
Example
Lucía from Buenos Aires (illustrative) requested her appointment online on 20 October 2025 and kept the confirmation email. In 2026 she received credentials to book her filing date. She files with her grandfather’s Spanish birth certificate, her father’s and her own Argentine birth certificates, apostilled, plus the proof of her timely request. Her file is valid even though she files after the deadline, because the request was made in time.
Example
James from London (illustrative) discovered in 2026 that his grandmother was born in Galicia and was Spanish when his father was born. He missed the LMD window. Because a grandparent was originally Spanish, he only needs one year of legal residence in Spain to apply for nationality by residence. He moves with a Non-Lucrative Visa, keeps his residence continuous and applies after twelve months. As a British national he will have to declare renunciation of his previous nationality at the oath.
9) Is a New Window Coming?
Associations of Spaniards abroad, including the General Council of Spanish Citizenship Abroad (Consejo General de la Ciudadanía Española en el Exterior, CGCEE), have asked Parliament for a permanent reform of the Civil Code on nationality for descendants of emigrants. These are proposals. At the time of writing (October 2026) we are not aware of any approved law that reopens the Democratic Memory window. Be wary of anyone selling “new LMD” applications.

FAQs
Can I still apply under the Democratic Memory Law in 2026?
No. The deadline was 22 October 2025. Only applications filed, or appointments requested, by that date are still being processed.
I requested an appointment before the deadline but have not filed yet. Is it too late?
No. Consulates are giving applicants with timely requests credentials to book a filing date. Keep the proof of your request and include it with your documents.
How long will my pending LMD file take?
There is no single answer. Backlogs are large: some consulates were still working on 2023 files in mid 2026. Check your consulate’s notices and keep your contact details up to date.
My LMD application was refused. Can I appeal?
Yes. LMD options are Civil Registry procedures, so the challenge goes first to the DGSJFP and later, if needed, to the civil courts. The decision must state the deadline: act quickly.
Can great-grandchildren still become Spanish?
Not directly under the LMD now that it has closed. If your parent obtained Spanish nationality of origin, you may qualify through other routes, such as one year of residence in Spain as a descendant of an originally Spanish parent.
What if my grandparent was Spanish but I missed the window?
You can become Spanish after just one year of legal residence in Spain (Civil Code, art. 22.2.f). Nationals of Ibero-American countries also have a 2-year residence route.
Do I need to pass a Spanish exam for the residence routes?
Yes, residence routes require the CCSE test (Constitutional and Sociocultural Knowledge of Spain) and, unless you are a national of a Spanish-speaking country, the DELE A2 language diploma (Diploma of Spanish as a Foreign Language, level A2).
Will there be a new LMD window?
There are reform proposals, but no approved law reopening the window as of October 2026.
