Can I work in another EU country with a Spanish residence card?

As a member of the European Union, Spain offers several advantages regarding the free movement of people. However, it is essential to understand the limitations and possibilities of having a Spanish residence card.

For example, if you have a Spanish residence card, it does not automatically allow you to work or legally reside in another EU country, such as the Netherlands or France. Although you can travel freely as a tourist within the Schengen Area, to work or settle in another member state, you must apply for a specific residence and work permit in that country.

Nationality and Rights

It’s important to understand that, even if you have a temporary or permanent residence permit in Spain, your official nationality remains that of your country of origin. This means that, legally, you are not considered a Spanish citizen and, therefore, do not have access to all the rights that come with Spanish nationality.

One of the most important rights is the freedom of movement and work within the European Union . Spanish citizens can live, work, and study in any EU member state without the need for additional permits. However, if you only have a Spanish residence card, these freedoms are limited.

For example, even if you may legally reside in Spain, you cannot move to France, Germany, the Netherlands, or another European country to work without first meeting that country’s specific immigration requirements, such as applying for a work or residence permit. This can entail a different administrative process for each country, with procedures that can be complex and time-consuming.

Furthermore, other benefits and rights associated with citizenship, such as the right to vote in national elections or the possibility of obtaining certain social benefits, are reserved exclusively for Spanish citizens.

Limitations of the Spanish Residence Card

The residence and work permit issued by Spain allows you to reside and work only within Spanish territory. It does not allow you to legally work in other European Union countries, as each member state has its own immigration regulations.

In addition, there are restrictions on staying outside of Spain: if you remain outside the country for longer than permitted (generally more than six consecutive months or 10 months total over a five-year period), you could lose your residence card. You would also lose your permit if you obtain a residence permit in another European country, as simultaneous legal residence in different EU states is not permitted without meeting certain specific requirements.
