Can W-2 Employees Actually Qualify?

YES! And that’s what makes Spain’s approach especially attractive.

While many digital nomad visa programs are geared toward freelancers or business owners, Spain allows traditional employees (like those on a W-2 in the U.S.) to apply, as long as the work is remote and the employer is located outside of Spain.

A formal letter from your employer is required, confirming that:

  • You’re allowed to work remotely.
  • Your role is compatible with living abroad.


Basic Eligibility Requirements

To apply as a W-2 employee, you’ll need to meet several criteria, including:

  • ✅ At least 3 months of remote work history with your current employer.
  • ✅ Proof of higher education or 3+ years of work experience in your field.
  • ✅ A monthly income of at least €2,6700, with higher amounts required if applying with family.
  • Clean criminal record, no overstay history in Spain.
  • ✅ Your employer must register with the Spanish Social Security system.


How to Apply: From the U.S. or Already in Spain

Spain offers two ways to apply for this residence permit:

  1. From the U.S., via your nearest Spanish consulate. You’ll be granted a 1-year visa. Once in Spain, you’ll have time to apply for a 3-year residence permit.
  2. From within Spain, if you’ve entered legally (e.g. as a tourist). You can apply directly for the initial 3-year residence permit.


Both routes lead to the same outcome: legal residency in Spain while you continue working for your U.S. employer.


Bringing Your Family

The visa allows you to bring your partner, children, and even dependent parents, as long as you can show sufficient income to support everyone. This makes it an excellent pathway not only for solo professionals, but for families seeking a lifestyle change.

  • Copy of your employment contract.
  • Employer’s statement authorizing remote work from Spain.
  • Evidence of income (pay slips, bank statements).
  • Proof of qualifications (degree or CV).
  • Clean background check (apostilled).
  • Passport and basic visa forms.
